These Terms and Conditions of Service (“Terms”) constitute a legally binding agreement between you and VIZIPIN LLC and its representatives, affiliates, officers, and directors (collectively, “Vizipin”) governing your access to and use of Vizipin’s real-time location-based platform, mobile applications, websites, and related services (collectively, the “Services”).

By using the Services, you agree to be bound by these Terms and our [Privacy Policy]. If you do not agree, do not use the Services.

• User – any person using the platform to request live updates, photos, videos, or other content (“Pins”) from a specific location.
• Fulfiller – any person who chooses to accept and complete a Pin request by providing content.
• Pin – a request for content placed by a User on the platform.
• Paid Pin – a Pin that requires payment to the Fulfiller for completion.
• Subscription Plans – optional paid plans that grant Users additional features, access, or privileges. Current plans include Vizi+ and Vizi Pulse, each offering distinct benefits as described within the Services.
• Platform – the Vizipin app, website, and related systems that connect Users and Fulfillers.
  

Vizipin provides a platform for connecting Users and Fulfillers. Vizipin is not a party to any agreement between a User and a Fulfiller. Fulfillers act as independent parties, not employees or agents of Vizipin.

You must be at least 18 years old (or the legal age of majority in your jurisdiction) to use the Services. We do not knowingly collect personal data from individuals under 18. If we learn we have collected data from a minor without consent, we will delete it promptly.

• Vizipin may modify these Terms at any time by posting the updated version in the Services. Continued use means you accept the changes.
• We may suspend or terminate your account for violations of these Terms, suspected fraud, illegal activity, or to protect the platform or its users.
  

• Users may post Pins requesting real-time content.
• Fulfillers may accept and complete Pins, optionally for payment through supported third-party processors.
• We do not guarantee the availability, quality, safety, or timeliness of Pin fulfillment.
• Fulfillers are independent parties, not employees or agents of Vizipin.

Upvotes, Response Limits & Ratings

Users have a limited number of responses they can send per session. The person who dropped the Pin can choose to upvote a response, which may allow that responding user to send additional responses for that Pin. After a session has ended, a rating system allows Users to rate each other’s performance or interaction. Upvotes, ratings, and response allowances are part of Vizipin's engagement features and may be modified or removed at Vizipin’s discretion.

You must:

• Create and maintain one active account.
• Provide accurate account and payment information.
• Maintain confidentiality of login credentials.
• Be responsible for all activity under your account.

By uploading or transmitting content through the Services, you grant Vizipin a worldwide, royalty-free, non-exclusive, transferable, and revocable license to use, reproduce, distribute, publicly display, and create derivative works for operating, promoting, and improving the Services, including marketing and promotional purposes. You are responsible for ensuring you have the necessary rights to any content you submit.

Payments:

• Users agree to pay for Paid Pins they request. Fulfillers may receive payments for completing Paid Pins.
• Payments are processed by third-party providers (Apple Pay, Stripe); certain taxes/fees may apply.
• All Payments are final unless Vizipin determines otherwise.
  

Subscriptions:

Vizipin offers optional subscription plans that provide additional access and features.

• Vizi+ may include premium engagement options, extended Pin visibility, and early access to new tools.
   
• Vizi Pulse may include advanced real-time interaction tools, enhanced response capabilities, and analytics features.
   

Subscription pricing, renewal terms, and included features are displayed at the time of purchase and may change with notice. By subscribing, you authorize Vizipin (or its payment processor) to charge your selected payment method on a recurring basis until you cancel. You can manage or cancel your subscription at any time through your device’s app store account settings.

Taxes:
Applicable taxes may be charged depending on your location. You are responsible for all taxes associated with your use of the Services.

Auto-Renewal Disclosure:
All Vizipin subscription plans (including Vizi+ and Vizi Pulse) renew automatically unless canceled at least 24 hours before the end of the current billing period. Your account will be charged for renewal within 24 hours prior to the end of the current period, at the rate shown when you first subscribed, unless the price has changed with prior notice. You can manage or cancel your subscription at any time through your Apple App Store or Google Play Store account settings. Deleting the app does not cancel your subscription. No partial refunds are issued for unused portions of a billing period.

All purchases and subscription payments are non-refundable, except where required by law or where Vizipin determines otherwise at its sole discretion. Chargebacks or payment disputes may result in account suspension. Before arbitration, you must contact us to attempt resolution.

By using the Services, you may grant access to your location, camera, and microphone to enable features like Pins, live updates, and map functions. You may disable permissions in device settings, but some features may not work.

Meeting in person or traveling to a location is at your own risk. We do not verify the safety, legality, or appropriateness of locations or requests. You are responsible for complying with all applicable laws, including recording, privacy, and public conduct laws.

Community Guidelines
You agree to follow our [Community Guidelines] at all times when using the Services. Any violation of the Community Guidelines is considered a violation of these Terms and may result in suspension or termination of your account, removal of content, or other enforcement actions at 

Vizipin 's sole discretion. These rules are designed to protect our community and ensure compliance with app store requirements.

You may not post, request, fulfill, facilitate, or otherwise engage with Pins, messages, or other activity that includes or results in:

11.1 Defamatory, discriminatory, or mean-spirited content, including references or commentary about religion, race, sexual orientation, gender, national/ethnic origin, or other targeted groups, particularly if the content is likely to humiliate, intimidate, or harm an individual or group. Professional political satire and humor are generally exempt from this requirement.

11.2 Realistic portrayals of people or animals being killed, maimed, tortured, or abused, or any content that encourages violence. In games or interactive features, “enemies” must not solely target a specific race, culture, real government, corporation, or other real entity.

11.3 Depictions that encourage illegal or reckless use of weapons or dangerous objects, or that facilitate the purchase of firearms or ammunition.

11.4 Overtly sexual or pornographic material, defined as explicit descriptions or displays of sexual organs or activities intended to stimulate erotic rather than aesthetic or emotional feelings. This includes hookup apps, pornography, or content that facilitates prostitution, human trafficking, or exploitation.

11.5 Inflammatory religious commentary or inaccurate/misleading quotations of religious texts.

11.6 False information or misleading features, including inaccurate device data, trick/joke functionality, or fake location trackers. Features that enable anonymous or prank phone calls or SMS/MMS messaging are prohibited.

11.7 Harmful concepts that capitalize on or seek to profit from recent or current events, including violent conflicts, terrorist attacks, epidemics, or other crises.

11.8 Circumventing, attempting to circumvent, or encouraging others to circumvent Vizipin's payment systems or other transactional processes.

11.9 Engaging in conduct that harms, attempts to harm, or could reasonably be expected to harm the platform, other users, or third parties — including actions that impair, disrupt, or otherwise negatively affect the operation or integrity of the Services.

11.10 Any other content or activity that Vizipin determines, in its sole discretion, to be harmful, unsafe, inappropriate, disruptive, or inconsistent with the spirit of these guidelines — even if not explicitly listed above.

Experimental features may be offered “as is” and may change or be removed.

The Services are provided “as is” and “as available.” Vizipin's total liability is limited to the greater of $100 or the total you paid us in the 12 months before the claim. We are not liable for indirect or consequential damages.

You agree to indemnify Vizipin from any claims arising from your use of the Services or violation of these Terms.

Disputes will be resolved exclusively by binding arbitration in King County, WA, under AAA rulesYou waive the right to participate in class actions. You may opt out of arbitration within 30 days of account creation. This does not prevent you from using small claims court where permitted.

If you download the app from Apple App Store or Google Play, you must comply with their terms.Apple, Google, and other providers are not responsible for the Services or liabilities. Licenses granted to you by Vizipin are revocable at our discretion.

These Terms are governed by Washington State law.
